3 examples of potential legal malpractice

We recently discussed how a conflict of interest can be an example of legal malpractice. If your lawyer is representing you against someone else and you later find out that those two have an existing relationship, it may be a conflict of interests that makes you wonder if your lawyer was really putting you first. If you lost the case, you may believe that you would have won if your lawyer had been fully on your side.

But this is certainly not the only way that legal malpractice takes place. Here are a few other examples to keep in mind.

Monetary issues

In some cases, a lawyer will be accused of misusing finances. Say that you had to file paperwork and different fees needed to be paid. You gave your lawyer the money to cover those fees, but the lawyer spent it on something else, and so the paperwork couldn’t be filed. They have misappropriated or misused financial assets.

Missed deadlines

Missing a deadline can be a very significant issue. For instance, there could be a statute of limitations of two years on your case. If you’re getting close to that deadline and your lawyer says that they can get everything filed in time, but then they miss the deadline, it may become impossible for you to start the case at all.

Legal failures

Finally, if the lawyer simply didn’t understand the law or didn’t apply it correctly, it may be legal malpractice. You have specifically hired a lawyer because the legal system is complicated and you trusted them to help you navigate it.
